Kosovar Working Group reform of enforcement law visited the Netherlands and Belgium (October 2010)
Between 18 - 22 October 2010, a Kosovar working group, entrusted by the Minister of Justice with the reform of enforcement law, visited the Netherlands and Belgium. The working group consists of high-level representatives of the Ministry of Justice of Kosovo, the Kosovar Judiciary, attorneys-at-law and university professors.As of July 2010, BERP in cooperation with the USAID funded SEAD project, supported the working group in developing a set of amendments to the 2008 Law on Executive Procedures. In order to facilitate the discussion around the proposed amendments regular working meetings of the working group were organized in Kosovo. The working group finalized its first task to prepare the amendments to the 2008 Law on Executive Procedure in the end of September. As of then, the working group started to focus on its second task: the development of a more efficient and effective system of enforcement. Already in January 2010, BERP facilitated a short study visit for a Kosovar delegation to see the two-track system of enforcement in Bulgaria. Based on further discussions after the trip to Sofia, the leading opinion among the key decision makers in Kosovo seems to be to direct future reforms towards a private system. It is against this background that BERP and SEAD organized a study visit to the Netherlands and Belgium. During the study visit, the members of the delegation were informed about the main features of the Dutch and Belgium enforcement systems. For this purpose, meetings were organized with representatives of the Royal Netherlands Organization of Enforcement Agents, the Netherlands disciplinary court of appeal for enforcement agents and a Belgium enforcement agent. In addition, two enforcement offices in the Netherlands and one enforcement office in Belgium were visited. Based on the information, received during the study visit, the Kosovar delegation will continue its work towards a more efficient and effective enforcement system in Kosovo.
